1. Agreement
These Terms of Service (“Terms”) govern your access to and use of the websites, platforms, and software solutions provided by FFS Software Solutions L.L.C. (“FFS”, “we”, “our”, or “us”), including but not limited to DigiCase Cloud, CXLink, DigiXP, DigiCharity, eMasraf, and related services (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Services.
2. Services Provided
FFS provides enterprise software solutions delivered through cloud-based (SaaS), on-premise, or hybrid deployment models, depending on the product and agreement.
Services may include, but are not limited to:
Case management and workflow platforms
Digital experience and customer engagement solutions
Charity, donor, and financial service platforms
Related support, hosting, and professional services
Features, limits, and service levels vary based on the subscribed plan (e.g., Starter, Pro, Enterprise) and applicable service agreements.
3. Account Responsibilities
You agree to:
Provide accurate, complete, and up-to-date registration information
Maintain the confidentiality of your login credentials
Be fully responsible for all activities conducted under your account
You must not use the Services for:
Illegal, fraudulent, or harmful activities
Uploading malicious code or unlawful content
Spamming, abuse, or unauthorized access attempts
FFS reserves the right to suspend or restrict access if misuse is detected.
4. Billing & Payment
Fees are charged on a monthly or annual basis according to your selected plan
All fees are non-refundable unless otherwise stated in a written agreement
Plan upgrades take effect immediately and may result in prorated charges
Plan downgrades take effect at the start of the next billing cycle
Failure to complete payment may result in service suspension or termination.
5. Intellectual Property
All software, platforms, documentation, trademarks, and intellectual property related to the Services remain the exclusive property of FFS Software Solutions L.L.C.
These Terms do not grant you ownership rights to the Services or related intellectual property
Customers retain ownership of:
Their data, content, and materials uploaded or generated within the Services
FFS may use aggregated and anonymized data for analytics and service improvement.
6. Data & Privacy
Your use of the Services is subject to our Privacy Policy, which describes how personal and operational data is collected, used, and protected.
Customers remain responsible for the legality and compliance of the data they upload or process using the Services.
7. Service Availability & Liability
The Services are provided on an “as is” and “as available” basis, subject to defined uptime targets and service levels where applicable.
To the maximum extent permitted by law:
FFS is not liable for indirect, incidental, special, or consequential damages
FFS is not responsible for data loss beyond the commitments stated in the applicable SLA
Total liability shall not exceed the fees paid by the customer for the affected service period
8. Termination
You may terminate your subscription at any time in accordance with your account or service agreement.
FFS may suspend or terminate access:
For violations of these Terms
For non-payment
For security, legal, or regulatory reasons
Upon termination, access to the Services will be disabled, and data retention will follow the applicable policy or agreement.
9. Changes to the Terms
FFS may update these Terms from time to time.
Updated Terms will be posted on our website with a revised “Last Updated” date. Continued use of the Services constitutes acceptance of the updated Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, with jurisdiction in Dubai, unless otherwise agreed in writing.
